We sold our home to Manatee LLC and found their process to be effortless for us. We called Andrew, he came out the next day to inspect the property and the following day made an offer that was acceptable. The contract was written in plain English which made the process very understandable. The closing date was flexible and as it turned out we did have to move up the date. Unfortunately, this buyer is the same as others “we buy your home type”. They use a very dangerous “contract” they would like you to sign. Very favorable to the buyer, but it could be disastrous and potentially ruin your life if you accept it. You will receive his low offer, and if everything goes fine and this buyer is satisfied with the money they are going to make, good, but by their contract, you could find yourself in a situation where you could lose time and money. Things on their contract: Dangerous Provisions in the Purchase Agreement Unrestricted Assignment and Novation Rights: You are essentially giving this company a "blank check" to sell your home to anyone else for a profit before the closing date. You lose control over who you are doing business with. Marketing Your Home Before They Own It: Their contract allows them to use your home as "inventory" to find a higher bidder while you are still the legal owner, and wastes your time when they are trying to sell your home to someone else. So if you are in a hurry, think again, it could potentially take longer than a regular sale on the MLS. Extreme Remedy Imbalance: By their “contract”, If the buyer defaults and refuses to buy the house, your only remedy is to keep their small deposit. If you (the seller) default, the buyer has the right to "all legal and equitable remedies," including Specific Performance. The Risk: This means they can sue to force you to sell your home, but you cannot sue to force them to buy it. Total "As-Is" Liability: The buyer places 100% of the risk for all defects on you, and the seller warrants nothing about the condition. The Risk: While "As-Is" is common in Florida, when combined with the other predatory terms, it ensures the buyer has no responsibility once the papers are signed. They may come back to you on day 4 and say, "We found $10,000 worth of issues. We won't close unless you drop the price by $10,000." They can walk away for free, but you are pressured to say yes to keep the deal alive, or face to be sued if you disagree. Vague Termination Power: By their “contract”, the buyer can terminate the agreement for any reason if they determine the property is "not suitable" for their use during “inspection” period, at which point the deposit is simply returned to the buyer. The "Inspection Period" in their “contract” is not just for checking the plumbing or the roof, it is “legally” designed to allow them to use your home as a showroom for their own profit before they even own it. The Risk: This makes the contract "illusory"—it is essentially an option for them to walk away for free while your home is tied up and off the market. Seizure of Personal Property: Their “contract” states that any personal property left in the home after closing, immediately becomes the property of the buyer. The Risk: This includes everything, appliances not built-in, or sentimental items. It allows the buyer to claim ownership of anything you might have accidentally left behind or were unable to move in time. Indefinite Closing Delays: The buyer can unilaterally delay the closing for “up to 30 days to clear title defects” and has the sole power to decide whether to terminate or extend further. The Risk: This can leave you in "limbo" indefinitely, unable to move forward with your own plans, while the buyer maintains control over the deal. Again, don’t do it, this buyer is not a person to take seriously. When I pointed out all the issues with their “contract”, all the sudden lost interest on my home. The buyer offered a change to a (FAR/BAR) 'As-Is' standard contract, as like he was offering a legit “contract”. But also wanted me to accept and include these dangerous terms on a (FAR/BAR) 'As-Is' standard contract, which right there, defeats the purpose of a (FAR/BAR) 'As-Is' standard contract. A (FAR/BAR) 'As-Is' standard contract would never include such danger to the seller terms. This should tell you everything you need to know about this “buyer”. Seller beware

Andrew is a standup man. I highly recommend him. I recently sold my "distressed" home in Englewood. I was under contract with Andrew, but I decided to go with another buyer. Andrew was great about the switch. Frankly, I wish I had stayed with Andrew. In short, there were issues, and Andrew graciously guided me through the process with no compensation. Also, and he said this at our first meeting, Andrew is not a wholesaler. I didn't understand that, but now I do. Wholesalers often string you along while they look for another buyer to sell to. If they can't find one, they can back out of the deal.
